• Vessels will be supplied with a notarized Bill of Sale and a HM Customs clearance to depart the territory of the British Virgin Islands.
• Preview viewing is available on site at Virgin Gorda Yacht Harbor strictly by appointment.
• Vessel sale will be conducted under the terms of an IYBA sales agreement and a 10% non-refundable deposit will be payable within 24hrs of the winning bid.
• A 30 minute virtual viewing is available on request for a fee of $150 (contact us for an appointment and details.)

1. Non-Refundable Deposit: “Please note that a non-refundable deposit is required for each successful auction bid. Failure to complete the purchase as per the auction terms will result in the forfeiture of this deposit.”
2. Customs Fee: “A 5% customs fee will be added to the final auction price of each boat, which must be paid by the buyer as a prerequisite for ownership transfer. This fee is non-negotiable and mandatory.”
3. Indemnity for Previous Ownership Claims: “The seller guarantees the absence of prior claims or encumbrances on each vessel. The buyer acknowledges that the seller will indemnify and hold the auctioneer harmless from any disputes arising from past ownership issues.”
4. Disclaimer of Auctioneer’s Liability: “The auctioneer is not responsible for any warranties, guarantees, or representations concerning the vessels’ condition, title, or history. All such information is provided by the seller, and any inaccuracies therein do not implicate the auctioneer.”
5. Limitation of Liability: “The auctioneer is exempt from liability for any problems stemming from the boats’ condition, any misrepresentations by the seller, or legal non-compliance, with the exception of cases involving auctioneer’s gross negligence or intentional misconduct.”
6. Governing Law: “This auction and any associated legal matters are governed by the laws of the British Virgin Islands. Participation in this auction constitutes agreement to this jurisdiction for resolving disputes.”
